Medi-Cal recovery, and how to avoid it

Under California Senate Bills SB 33 and SB 833, Medi-Cal can no longer collect from your estate if:

There Is a Surviving Spouse or Minor Child

Recovery is barred while a surviving spouse or a minor, blind, or disabled child survives you.

Benefits Were Received Before Age 55

Recovery generally applies only to benefits received at age 55 or older.

No Probate Is Opened After Death

Assets that pass outside probate, such as through a properly funded living trust, are protected from recovery.

Understanding Medicare

Medicare is a federal insurance program that is not based on financial need. It is available to people who:

  • Are 65 or older and paid into Social Security
  • Are under 65 with qualifying disabilities
  • Have end-stage renal disease

Covers short-term skilled nursing, not long-term care.
