CBM Estate & Trust Law

Effective date: September 24, 2026 Last updated: September 24, 2026

This Privacy Policy explains how Carmen B. Marquez, P.C., doing business as CBM Estate & Trust Law ("CBM," "we," "us," or "our"), collects, uses, shares, and protects personal information when you:

  • visit cbmestate.com or any other website, web page, or online form of ours that links to this Privacy Policy (together, the "Site");
  • fill out a form, book an appointment, or register for a seminar or event;
  • call, text, or email us before you become a client; or
  • agree to receive text messages or email updates from us.

About our firm. CBM Estate & Trust Law is a California law firm, and we practice California law. Nothing on the Site is an offer to provide legal services outside California or on matters that are not governed by California law.

What this policy does not cover. If you hire us, the information you share as a client is also protected by our professional duties as lawyers, including our duty of confidentiality and the attorney-client privilege, and by your signed engagement (legal services) agreement. Where those duties give you more protection than this policy, those duties control. This policy also does not cover other companies' websites that we link to.

Please read this first. Using the Site, submitting a form, calling, texting, or emailing us does not make you our client. An attorney-client relationship begins only after we have agreed to represent you and a written engagement agreement has been signed. We take care with the information you send us, as our professional rules require, even before you hire us. But website forms, text messages, and regular email are not a secure way to send sensitive details. Please send only your name, your contact information, and a brief, general description of what you need. Do not send Social Security numbers, account numbers, medical details, or the private facts of a family dispute until we ask for them through a secure method. See our Terms & Conditions.

Our privacy commitments at a glance

  • We do not sell your personal information.
  • We do not share your personal information for cross-context behavioral advertising (ads targeted to you based on your activity across other websites and apps).
  • The Site does not use advertising pixels, third-party analytics, or social media tracking tools.
  • We honor Global Privacy Control (GPC) and similar browser opt-out signals.
  • We send text messages only if you opt in, and only about your inquiry, your appointments, and your matter. Reply STOP at any time to opt out.
  • We never share your mobile number or text-message consent with third parties or affiliates for their marketing or promotional purposes.

1. Information we collect

We collect only the information we need to respond to you, schedule appointments and seminars, operate the Site, and meet our legal and professional obligations.

1.1 Information you give us

  • Contact details: name, email address, phone number (including mobile number), mailing address, preferred language, and preferred contact method.
  • Appointment and seminar details: the service you are interested in (for example, estate planning, trust administration, elder law, or Medi-Cal planning), preferred appointment times and office, seminar or event registrations, and how you heard about us.
  • Basic background you choose to share: for example, marital status, a spouse's or partner's name, whether you already have an estate plan, whether you have a legal-plan benefit through your employer, and a short description of what you need.
  • Timing information: if you ask us to move quickly, the reason and the date you need help by.
  • Messages: anything you write in a form, text, email, or voicemail.
  • Text-message choices: whether you agreed to receive text messages, when, and how, and any opt-out.
  • Payment information: if you pay us online, your card or bank details are collected and processed by our payment processor.

Health-related information. We do not ask for medical details through the Site. If you choose to tell us something health-related (for example, that you have an upcoming medical procedure and need an appointment soon), we use it only to respond to you and to prioritize scheduling. We do not use it for advertising and do not use it to infer characteristics about you.

1.2 Information collected automatically

When you visit the Site, the service providers that host and run it automatically receive standard technical information that every website receives: your IP address, browser type, device type, operating system, the date and time of your visit, the pages you request, and the web address that referred you. We use this information to deliver the Site, keep it secure, prevent spam and abuse, and fix problems.

How you found us. When you arrive at the Site through a link, for example from an ad, a search result, or one of our emails, the Site notes the page you first landed on and any campaign tags or ad click identifiers included in that link (codes in the web address that show which campaign, ad, or search the link came from). The Site keeps this information in your browser's session storage, a technology similar to cookies, until you close your browser window or tab. If you submit a form, the Site includes this information with your submission so we know how you found us and can direct your inquiry to the right person. When you submit a form or book an appointment, our systems may also record the page you submitted it from. The Site does not send this information to advertising platforms.

We do not use this information to build advertising profiles about you or to follow you across other websites. See Section 4.

1.3 Information from other sources

  • People who refer you, such as a family member, financial advisor, or other professional, who may give us your name and contact information.
  • Your employer's legal-plan provider, if you tell us you have a legal-plan benefit and we confirm your eligibility.
  • Public records, such as property records, when reasonably needed to respond to your request or check for conflicts of interest.
  • Online advertising platforms, if you respond to one of our ads by submitting your contact information in a form on that platform. The platform sends us the information you entered.

2. How we use information

We use personal information to:

  1. respond to your questions and requests;
  2. check for conflicts of interest and decide whether we can help you;
  3. schedule, confirm, and remind you about consultations, appointments, signings, seminars, and events;
  4. send you text messages and emails you have agreed to receive, and messages related to your request;
  5. operate, secure, and maintain the Site, including preventing spam, fraud, and abuse;
  6. keep records and meet our legal, regulatory, insurance, and professional obligations; and
  7. protect our rights and the rights and safety of our clients and others.

We do not use personal information from the Site for targeted advertising, and we do not sell it.

3. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose personal information only as described below.

  • Service providers. Companies that help us run our firm and the Site, under contracts that limit how they may use the information. These include providers of website hosting; customer relationship management (CRM) and client intake; appointment scheduling; messaging and communications (text messaging and phone service, including wireless carriers); email; document storage and electronic signature; workflow automation; IT and security; and payment processing.
  • Professional advisors and co-counsel, when needed and permitted by our professional duties, such as our accountants, insurers, or outside counsel.
  • Legal and safety reasons, when we believe disclosure is required by law, court order, or our professional rules, or is needed to protect the rights, property, or safety of our clients, our firm, or others.
  • Firm transitions, if our practice is sold, merged, or transferred, in a manner permitted by the California Rules of Professional Conduct and applicable law.
  • At your direction or with your consent.

Text-message privacy promise. We will not share, sell, rent, or trade your mobile phone number or your text-message opt-in or consent with any third parties or affiliates for their marketing or promotional purposes. The only companies that receive this information are the service providers, such as our messaging platform and wireless carriers, that need it to deliver our messages to you.

4. Cookies, tracking, and your online choices

No advertising or analytics tracking. The Site does not use advertising pixels, third-party analytics, or social media tracking tools, and we do not use cookies to show you ads.

Consent-first analytics is prepared but inactive. We have prepared code that could use Google Analytics 4 to measure query-free page paths and clicks on phone, email, and consultation links only after a visitor opts in. It is currently disabled: the Site does not load the Google Analytics script or send analytics requests. Before any activation, we will update this policy as needed and provide a consent choice. We will not send form contents, contact details, search terms, URL queries, or ad-click identifiers to Google Analytics through this integration.

Essential and functional cookies and similar technologies. The Site, and the forms and booking tools on it, use a small number of cookies and similar technologies (such as local storage and session storage) that are needed for the Site to work or to provide features you use. For example, they help keep the Site secure, prevent spam, make forms and appointment booking function, and remember choices such as your language. You can block or delete cookies and stored site data in your browser settings, but some forms or booking features may not work if you do.

How you found us (session storage). As described in Section 1.2, if the link you used to reach the Site contains campaign tags or ad click identifiers, the Site stores them, together with the page you landed on, in your browser's session storage. This is not a cookie, and it is deleted when you close your browser window or tab. The Site uses it only to include this information with a form you submit, so we know how you found us. The Site does not send it to advertising platforms, and we do not use it to show you ads or to follow you across other websites. You can also remove it by clearing your browsing data.

Third-party content. Some pages may display content provided by other companies, such as an embedded map or web fonts. To show that content, your browser connects directly to the other company, which receives standard technical information such as your IP address, browser type, and the address of the page you are viewing, and which may set or read its own cookies under its own privacy policy. We do not use this content for advertising or analytics.

Third-party tracking across websites. We do not use advertising or analytics tools on the Site, and we have not authorized any other company to collect personal information about your online activities over time and across different websites through the Site for advertising or analytics. When content from another company appears on the Site (see "Third-party content" above), or when you follow a link from the Site to another company's website or service (for example, a social media page), that company may collect information under its own privacy practices, which we do not control.

Do Not Track. Some browsers can send a "Do Not Track" (DNT) signal. Because the Site does not use advertising or analytics tools or track you across other websites, the Site works the same way whether or not your browser sends a DNT signal; this includes the session storage described above, which is used only for your own form submission. Other companies whose content appears on the Site decide for themselves how to respond to DNT.

Global Privacy Control. If your browser or a browser extension sends a Global Privacy Control (GPC) signal or a similar opt-out preference signal, we treat it as a valid request to opt out of the sale or sharing of personal information linked to that browser or device and, if we know who you are, to you. Because we do not sell or share personal information, you do not need to do anything else. Learn more at https://globalprivacycontrol.org.

5. How long we keep information

We keep personal information only as long as reasonably necessary for the purposes described in this policy. How long depends on:

  • why we collected it and whether you become a client;
  • our legal, ethical, insurance, and record-keeping obligations;
  • the need to check for conflicts of interest (we may keep basic information, such as your name, the names of others involved, and the general subject of your inquiry, for as long as needed for that purpose); and
  • whether the information is needed to resolve a dispute or protect legal rights.

Text-message consent and opt-out records are kept as long as needed to honor your choices and document your consent. Client files are governed by your engagement agreement and our file-retention policy. When information is no longer needed, we delete it or de-identify it.

6. Your California privacy rights

6.1 Who may use these rights

California law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the "CCPA"), gives California residents certain rights over their personal information. We honor the requests described in this section from California residents whether or not the CCPA applies to our firm, subject to the exceptions California law allows.

Some privacy obligations do not apply where following them would violate an evidentiary privilege under California law, such as the attorney-client privilege, or our professional duties as lawyers. We may withhold or limit information for those reasons, and we will tell you when we do.

6.2 Categories of personal information we collect

The table below uses the category names in California Civil Code section 1798.140.

Sensitive personal information. We use and disclose sensitive personal information only for purposes the CCPA permits, such as providing the services you request, and not to infer characteristics about you.

6.3 Your rights

Subject to the exceptions in the law, you have the right to:

  • Know and access: ask what personal information we have collected about you, the categories of sources, why we collected it, the categories of recipients, and the specific pieces of personal information we have about you.
  • Delete: ask us to delete personal information we collected from you. We may keep information when the law allows, for example to meet legal or professional obligations (including conflict-check records), to complete a transaction, or for security.
  • Correct: ask us to correct inaccurate personal information.
  • Opt out of sale or sharing: we do not sell or share personal information, and we honor GPC signals as described in Section 4.
  • Limit use of sensitive personal information: this right applies when a business uses sensitive personal information beyond the purposes the law allows. We do not, but you may contact us with any concern.
  • Non-discrimination: we will not deny you services, charge you a different price, or give you a different quality of service because you used your privacy rights.

6.4 How to make a request

You may make a request by:

  • Email: trusts@cbm.estate
  • Phone: (805) 915-4793
  • Mail: CBM Estate & Trust Law, Attn: Privacy Requests, 2655 First Street, Suite 110, Simi Valley, CA 93065

Verification. To protect your information, we will confirm your identity before we act on a request to know, delete, or correct. We usually do this by matching information you give us (such as your name, email address, and phone number) with information we already have, and we may send a code or link to the email address or phone number we have on file. For requests for specific pieces of information, we may ask for more. We use verification information only to verify your request. You do not need an account with us.

Authorized agents. You may use an authorized agent to make a request for you. We may ask the agent for proof that you gave them signed permission, and we may ask you to verify your identity directly with us or confirm that you gave the agent permission. These extra steps do not apply if the agent holds a power of attorney under California Probate Code sections 4121 to 4130.

Timing. We will confirm that we received your request within 10 business days and respond within 45 calendar days. If we need more time (up to 45 more days), we will tell you why.

7. California "Shine the Light"

California residents may ask once per calendar year whether we disclosed certain personal information to third parties for those third parties' own direct-marketing purposes during the previous calendar year. We do not disclose personal information to third parties for their own direct-marketing purposes. To ask, email trusts@cbm.estate or write to us at the mailing address in Section 15 with "Shine the Light Request" in the subject line.

8. Text messages

If you opt in, CBM Estate & Trust Law sends customer-care text messages about your inquiry, your appointments and consultations (scheduling, confirmations, and reminders), and your matter, such as document and signing coordination. If you register for a seminar or event and opt in, we may also text you reminders and logistics for that event. We do not send marketing or promotional texts, and we do not give legal advice by text.

  • Consent is optional. Agreeing to receive texts is not a condition of buying any goods or services or of hiring us.
  • Frequency: Message frequency varies.
  • Cost: Msg & data rates may apply.
  • Opt out: Reply STOP to any message to stop receiving texts. You can also reply QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT, or tell us by phone, by email, or in any other reasonable way. We may send one final message confirming your opt-out.
  • Help: Reply HELP for help, or call (805) 915-4793.
  • Carriers are not liable for delayed or undelivered messages.
  • Privacy: Mobile numbers and text-message consent are not shared with third parties or affiliates for marketing or promotional purposes (see Section 3).
  • Full text-message terms: https://cbmestate.com/terms-conditions#sms

Please don't text us confidential details about your legal matter. We will not use text messages to discuss the substance of your legal matter.

9. Email updates

If you sign up for email updates from us, such as seminar announcements, you can unsubscribe at any time by using the "unsubscribe" link in any of those emails or by contacting us. We will honor your request within 10 business days. Even after you unsubscribe, we may still send you messages related to your inquiry, appointments, or matter.

10. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No website, form, text message, or email is completely secure, which is one reason we ask you not to send sensitive details before you are a client.

11. Children

The Site is intended for adults. It is not directed to children, and we do not knowingly collect personal information from children under 16 through the Site. If you believe a child has given us personal information, please contact us and we will delete it.
