Terms & Conditions
CBM Estate & Trust Law — Website Terms of Use
Effective date: September 24, 2026 Last updated: September 24, 2026
These Terms & Conditions ("Terms") apply to your use of cbmestate.com and any other website, web page, or online form of ours that links to these Terms (together, the "Site"), and to text messages you agree to receive from us. The Site is operated by Carmen B. Marquez, P.C., doing business as CBM Estate & Trust Law ("CBM," "we," "us," or "our").
1. Accepting these Terms
By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you hire us, your signed engagement (legal services) agreement governs our legal services, and if that agreement conflicts with these Terms, the engagement agreement controls.
2. California practice
CBM Estate & Trust Law is a California law firm, and we practice California law. Nothing on the Site is an offer to provide legal services outside California or on matters that are not governed by California law.
3. No attorney-client relationship
Using the Site, reading our content, attending a free seminar, submitting a form, booking an appointment, calling, texting, or emailing us does not create an attorney-client relationship. We become your lawyers only after we have agreed to represent you and a written engagement agreement has been signed. Until then, we are not your lawyers and have not agreed to act for you, so please do not rely on us to meet any deadline or take any action for you.
4. Not legal advice
The information on the Site, including articles, practice-area pages, FAQs, videos, and seminar materials, is general information only. It is not legal advice, and it may not reflect the most current law or apply to your situation. Estate planning, trust, elder law, and Medi-Cal rules depend on your specific facts and can change. Please talk with a licensed California attorney about your situation before you act or decide not to act.
5. Please limit what you send before you are a client
We take care with the information you send us, as our professional rules require, even before you hire us. But website forms, text messages, and regular email are not a secure way to send sensitive details. To help us check for conflicts of interest and decide whether we can help, please send only your name, your contact information, the names of any other people involved, and a brief, general description of what you need. Please do not send Social Security numbers, account numbers, medical details, or the private facts of a family dispute until we ask for them through a secure method.
6. Attorney advertising
This Site may be considered attorney advertising under California law. The law firm responsible for this Site is Carmen B. Marquez, P.C., doing business as CBM Estate & Trust Law, with offices at:
- 2655 First Street, Suite 110, Simi Valley, CA 93065
- 655 N Central Ave, 17th Floor, Glendale, CA 91203
No guarantee of results. Any past results, client reviews, or testimonials on the Site depended on the facts of each matter. Results will differ based on different facts. They are not a guarantee, warranty, or prediction of the outcome of your matter.
No certified-specialist claim. Unless the Site specifically says otherwise and names the certifying organization, no attorney at CBM claims to be a certified specialist. Describing our practice as focused on estate planning, trust administration, and elder law does not mean that we are certified specialists.
7. Using the Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to:
- use the Site in a way that breaks any law or violates anyone's rights;
- submit false information, or information about another person without their permission;
- try to get unauthorized access to the Site, our systems, or other people's information;
- upload viruses or harmful code, or interfere with how the Site works;
- use bots, scrapers, or other automated tools to copy the Site or submit forms, except for search engines indexing public pages; or
- use the Site to send spam or unsolicited messages.
We may suspend or block access to the Site, or decline to respond to a submission, at any time.
8. Forms, appointments, and seminars
When you submit a form, you confirm that the information is accurate and that you are allowed to share it. Appointments and seminar registrations are subject to confirmation and availability, and we may reschedule or cancel them. We will make reasonable efforts to tell you about any change. Contacting us or booking a consultation does not mean we have agreed to represent you. We may decline any representation, including because of a conflict of interest.

9. Text Message Terms
These terms apply if you agree to receive text messages from CBM Estate & Trust Law.
- What we send. If you opt in, we send customer-care text messages about your inquiry, your appointments and consultations (scheduling, confirmations, and reminders), and your matter, such as document and signing coordination. If you register for a seminar or event and opt in, we may also text you reminders and logistics for that event. We do not send marketing or promotional texts, and no legal advice is given by text.
- Consent is optional. Agreeing to receive texts is not a condition of buying any goods or services or of hiring us. You can always reach us by phone or email instead.
- Frequency: Message frequency varies.
- Cost: Msg & data rates may apply. Check your mobile plan.
- Opt out: Reply STOP to any message to stop receiving texts. You can also reply QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT, or tell us by phone, by email, or in any other reasonable way. We may send one final message confirming your opt-out.
- Help: Reply HELP for help, or call (805) 915-4793.
- Carriers are not liable for delayed or undelivered messages.
- Your number: Only sign up with a mobile number that is yours or that you are allowed to use. If you change or give up your number, please reply STOP or tell us first.
- Privacy: Mobile numbers and text-message consent are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
- Don't text confidential details. Text messages are not a secure way to send confidential information, and texting us does not create an attorney-client relationship. We will not use text messages to discuss the substance of your legal matter.
10. Email updates
If you sign up for email updates from us, you can unsubscribe at any time by using the "unsubscribe" link in any of those emails or by contacting us. Emails from us are general information, not legal advice, and do not create an attorney-client relationship.
11. Intellectual property
The Site and its content, including text, graphics, logos, photos, videos, and design, are owned by or licensed to CBM and are protected by copyright, trademark, and other laws. You may view, download, and print pages for your own personal, non-commercial use, as long as you keep all copyright and other notices. You may not copy, republish, sell, or create derivative works from the Site without our written permission.
12. Third-party links and tools
The Site may link to, or use tools from, other companies (for example, maps, calendars, videos, payment processors, or social media). We do not control and are not responsible for their content, security, or privacy practices. Your use of their websites and tools is subject to their own terms and privacy policies.
13. No warranties
We try to keep the Site accurate and available, but the Site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, secure, or free of viruses, or that its content is complete or current.
14. Limitation of liability
To the fullest extent the law allows, CBM and its attorneys, staff, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising from your use of, or inability to use, the Site or its content, even if we were told such damages were possible.
This section applies only to your use of the Site. It does not limit any liability for legal services provided under a signed engagement agreement, and it does not limit any liability that cannot be limited under California law, such as liability for fraud, willful injury, or violation of law.
15. Governing law and where disputes are decided
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. To the extent the law allows, any dispute about these Terms or the Site will be decided in the state courts located in Ventura County, California, or, if a federal court has jurisdiction, in the United States District Court for the Central District of California, and you and we consent to the jurisdiction of those courts. These Terms do not require arbitration and do not waive anyone's right to bring or join a class action. This section does not apply to disputes about legal services or fees under a signed engagement agreement, which are governed by that agreement and applicable law.
16. Age
The Site is intended for adults. You must be at least 18 years old to submit a form or sign up for text messages.
17. Accessibility
We want the Site to be usable by everyone. If you have trouble using any part of the Site, please call (805) 915-4793 or email trusts@cbm.estate, and we will help you get the information or service another way.
18. Spanish translation
A Spanish translation of these Terms is available at https://cbmestate.com/es/terms-conditions. The Spanish translation is provided for your convenience. If there is any conflict between the English and Spanish versions, the English version controls.
19. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date. Changes apply from the date they are posted and do not apply to disputes that arose before that date. If you keep using the Site after changes are posted, you accept the updated Terms.
20. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about your use of the Site. They do not replace any engagement agreement.
