Estate Planning and Living Trusts for Thousand Oaks Residents
Thousand Oaks families often already have a will, a trust from another state, or a California plan that has not been looked at since the house was purchased. Carmen B. Marquez has practiced since 2001, and CBM Estate & Trust Law was founded in 2012. This page is general information for that review. It is not legal advice.

In Ventura County, probate, trust, conservatorship, and guardianship matters are filed and heard at the Superior Court's Juvenile and Probate Courthouse, 4353 E. Vineyard Avenue, Oxnard. A court petition about a living trust is generally filed in the county where the trust is administered (California Probate Code section 17005). Most trust administration happens without court. We do not handle probate matters.
Living trusts for Thousand Oaks homeowners
A Thousand Oaks house follows the trust when the deed names the trustee of that trust. A properly funded trust may help avoid probate for assets titled in the trust. A trust that still names you as an individual on the deed has not picked up the house. See Living Trust vs Will in California and How to fund a California living trust. The service page is Living trusts.
If the home may pass to a child, Proposition 19 is a property tax question, not a title question. The trust does not, by itself, keep a parent's tax base. Read the Prop 19 parent-child exclusion guide before you assume an old trust still does what you want.
Trust administration when a Thousand Oaks parent passes
A successor trustee in Thousand Oaks starts by reading the trust, securing the home, and learning the notice deadline. Distribution comes later. Most of this work is not a court case. We do not handle probate matters. The overview is trust administration.
Wills, powers of attorney, health care directives
A will still matters if minor children need a guardian nomination, or if some assets were never moved into the trust. A pour-over will is the backup for those leftovers. A durable power of attorney and an advance health care directive are the documents for incapacity during life. Read the wills page, and use trust funding when the question is the deed or an account title.
Local questions
How long does it take to set up a living trust for a Thousand Oaks home?
Timing depends on the deed, any lender requirements, and how quickly the family makes decisions about trustees and beneficiaries. A single home with clear title is a different project from several properties or a blended family. This page does not promise a number of days or weeks. The schedule is discussed at the complimentary 60-minute consultation.
What should a successor trustee in Thousand Oaks do first?
Read the trust and any amendments, secure the home, and order certified death certificates before you pay beneficiaries or list the house. The California successor trustee checklist is the orientation, and trust administration explains the notice. We do not handle probate matters.
Do I need to update a trust made in another state after moving to Thousand Oaks?
A trust signed in another state is not automatically void because you now live in Thousand Oaks. The deed to the California house, the trustee's powers, and California property tax rules can still need a review. Moving, by itself, is not a reason this page can give you to start over. Bring the trust and the deed to a consultation. Meetings at our Simi Valley office, or by video or phone.
